The route known locally as ‘Piggy Lane’, because of its access to piggeries following the war, has been a well used route between Newbridge Lane and Penwethers Lane since before 1748.
Councils are required to create and maintain a Definitive Map of Rights of Way for their area, but unfortunately, the Map for Cornwall does not show Piggy Lane as an established right of way, despite its historical status and regular use by the local community.
In 2019/2020 the Bridlepath/Public Byway signs were removed and an unlocked pedestrian access gate was installed at the Newbridge Lane end.
On 16th May 2020 the Ramblers Association submitted a formal application for the Definitive Map to be modified to recognise 'Piggy Lane' as a Restrictive Byway (a byway open to walkers, cyclists, horse riders and users of non-motor propelled vehicles). The Definitive Map Modification Order (ref WCA 715) is shown on the Interactive Map produced by Cornwall Council, however, it is still pending a decision and because of its current priority (at 190 within the list of open applications) it is unlikely to be considered for a further 5-6 years. The review and inquiry process may take an additional 2-3 years before a decision is made!
Within Cornwall Council the councillor for the Malabar Ward (Karen La Borde) and others are keen to see an early decision to confirm this route as a Right of Way. Resolution of the anomaly has become urgent with the Dudman Farm development and the current blockage of the route with security fences and cameras by Wain Homes.In order to move the application up the queue for review, we urgently need to provide witness statements to supplement the historical position advanced by the Ramblers Association.
This is a formal process and the Council provides a Public Path User Form for individuals to document their use of the path.
Karen has asked us to submit as many Public Path User Forms as possible to support prioritising the application.
